At first glance, Guberman’s discourse might appear to be a tangled mess of information. However, if you take the time to look deeper into his point of view, you will find that he has carefully put together interconnected issues. These issues, unfortunately, are currently causing significant problems for Boeing, a company that has always been at the forefront of the aerospace industry. Boeing’s Regulatory Autonomy
Daryl Guberman, in his critique, starts by discussing a big company named Boeing. This company makes airplanes, which are very important in the aviation industry. Guberman talks about something called ‘regulatory autonomy’ that Boeing has had since 2009. This is a big term, but it simply means that Boeing has FAA power to regulate or control itself, especially when it comes to dealing with the Federal Aviation Administration (FAA). Guberman says that because Boeing has had this power to regulate itself since 2009, it was able to hide some very important information about something called the MCAS system. This system is a part of their 737 MAX airplanes. Unfortunately, there were some crashes (Indonesian & Ethiopian airlines) involving these airplanes, and Guberman believes that the hidden information about the MCAS system played a role in these sad events. He also says that Boeing’s ability to hide this information shows a lack of transparency. When we say a company is transparent, it means they are open and honest about what they are doing. Finally, Guberman claims that this situation shows there are some big problems in the way Boeing is run. He knows and illustrates this in featured articles and on his YouTube channel. There are deficiencies or areas where Boeing needs to do more in their governance framework. This is a fancy way of saying the system or structure they have for making decisions and controlling the company. He believes these problems need to be fixed to prevent such sad events from happening again in the future.
Interconnected Relationships
Central to Guberman’s argument is the complex relationship between Boeing and several important groups that give accreditations or approvals. Three of these groups are the American National Standards Institute (ANSI), the American National Accreditation Board (ANAB), ANSI took over complete control of ANAB in 2018, and the International Accreditation Forum (IAF incorporated in Delaware, USA). The International Accreditation Forum (IAF) serves as a repository for accreditation bodies at both the national and international levels, all of which are on par with the accreditation of ANSI-ANAB who act as underwriters for the IAF and the International Laboratory Accreditation Cooperation (ILAC), based in Australia, is an organization that operates in parallel to the IAF with ANSI being the founding member of the IAF. These are big names, but they are basically groups that set standards and give approvals to companies like Boeing. ANSI-ANAB is over a one-hundred-year-old non-profit, non-governmental corporation that has Corporations like (Boeing, Lockheed, Pfizer, and J&J) and Federal Agencies like (FDA, FAA, DOT, FBI, and DOJ). That sit on the boards of ANSI-ANAB.
Guberman has illustrated in featured articles and on his YouTube channel that Boeing has a very close relationship with these groups. He says that Boeing is part of these groups’ boards. A board is like a team of people who make decisions for a group. So, Boeing being on these boards is like having a student grading their own homework. This, Guberman says, gives Boeing too much power or influence over the accreditation processes. Guberman states that his own enterprise, a registration company for quality certification, is being excluded from Boeing (similar problems are also present with Lockheed Martin). He argues that Boeing’s participation on these boards inhibits competition. This overt suppression of Guberman’s registration company constitutes a clear violation of trade and is against the law. Sherman Antitrust Act, a federal anti-monopoly and anti-trust statute, passed in 1890 as 15 U.S.C. §§ 1-7 and amended by the Clayton Act in 1914 (15 U.S.C. § 12-27). This means it is making it hard for other companies to compete. He also says it is impeding regulatory oversight. This means it is getting in the way of the checks and balances that are supposed to make sure everything is done correctly and fairly. Let us explain. At the time, the American Society for Quality (ASQ) and ANSI each held a 50% stake in ANAB. Guberman’s approval in 2013 and the invitation to join ANAB or IAF in 2016 were never communicated to companies like Boeing. Guberman declined to join ANAB or IAF due to his belief in competition and the IAF was controlled by a Communist Chinese national. The IAF was headed by Xiao Jianhua, a Communist Chinese National who had been involved with USA quality since 1994 and served as the IAF Chairman from 2015 to 2021. Concurrently, he was also the Chief Executive of the China National Accreditation Services (CNAS), which is equivalent in accreditation to ANSI-ANAB, based in Beijing, China. Xiao was also responsible for certifying the laboratory in Wuhan, China. Furthermore, he was required by Communist China to engage in espionage via the China National Intelligence Law Article #7.
Boeing is employing three restrictions that contravene the Sherman-Clayton Act of 1914. Guberman has sought legal representation, but he has stated that the board of ANSI-ANAB includes members from the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI), and they are implicated in the matter that they are involved with the ABA American Bar Association.
1. 2OO2 Boeings supplier bulletin – In essence, it’s saying that suppliers should submit their AS 9100 Aerospace certification to Boeing, but only those accredited by ANSI-NAP-RAB (ANSI-ANAB), given that Boeing is a member of the ANSI-ANAB boards. Once the supplier sends in the parts, Boeing is not required to send auditors to the supplier. (This practice has been ongoing for 22 years.)
2. Boeing Supplier Portal – The portal calls for the ANSI-ASQ national accreditation board ANAB or its international equivalent.
3. Boeing Sits On ANSI-ANAB boards of directors, which manage the direction of the company, and the Management Systems Accreditation Committee can grant, suspend, or withdraw certification of registration bodies.
In simple words, Guberman is concerned and shows this in featured articles and his YouTube channel, saying that Boeing is too close to the groups (ANSI-ANAB/IAF/ILAC and others). They are supposed to be assuring suppliers and subcontractors comply with AS 9100 international standards. He knows these close ties and interlocking directorates are causing problems (Guberman has all corroborating documentation of proof) for other companies and for the way things are supposed to work in the industry.
External Interference and Security Concerns
Daryl Guberman raises concerns about the approvals of these groups, like ANSI-ANAB and IAF-ILAC. He thinks these groups might be too open to influence from outside forces. This is a big concern because these groups are supposed to be fair and unbiased.
One example Guberman gives is when, in 2015-2021, Xiao Jianhua, a Communist Chinese national who has been involved in quality (USA and world) since 1994, got a big job within the IAF being handed off Chairmanship. At that time, he also held the position of Chief Executive at the China National Accreditation Services (CNAS), which is on par with ANSI-ANAB in terms of accreditation based in Beijing, China. Additionally, Xiao was responsible for the certification of the Bio-Level-4 laboratory located in Wuhan, China. And when this person was given a leadership position, which means they have a lot of power and influence within the group. Guberman is concerned about this because he thinks this person might have used their position in ways that are not good. In 2017, Randy Doughtery, a Technical Advisor for ANSI-ANAB and Principal on the IAF 990 tax form, who transferred the IAF to China, was featured on the DHS (Department of Homeland Security) website. At the time when Randy was publicized on the DHS government site (A DHS employee at the time Phil Mattson was receiving his federal salary and compensation from ANSI of $250,000 as a royalty payment: which may or may not be taxed via IRS), Xiao Jianhua was serving as the Chairman of IAF (from 2015 to 2021) and the Chief Executive of CNAS. DHS was hacked by China. Guberman inquires if there could have been a channel for collecting information from DHS to IAF in 2017, given that DHS is a board member of ANSI-ANAB and also holds a membership in IAF.
One of the bad things Guberman thinks this person might have done is compromising data security. This means they might have made it easier for people to access data that should be kept safe and private. This is a big problem because it can lead to information getting into the wrong hands.
Guberman also thinks that during the 2015-2021 term of Xiao Jianhua, he helped create a climate of regulatory laxity within the IAF, ILAC, and board members of ANSI-ANAB. This is a fancy way of saying that the rules and checks that are supposed to be in place were not being followed as strictly as they should be. This can lead to all sorts of problems, such as mistakes being made or people not doing their jobs properly, and diminishes the value of quality certifications.
One big mistake that Guberman talks about is the mishandling of laboratory protocols. Protocols are like rules or instructions that people in a lab are supposed to follow to make sure everything is done safely and correctly. However, Guberman comments about Xiao’s tenure, concerns arose regarding the training and protocols within the Wuhan lab. In 2018, Diplomats Warned of Risky Coronavirus Experiments in a Wuhan Lab. In a 2019 CDC Volume 25, Number 5-May 2019 training document for virology labs, the only lab mentioned was the Wuhan lab Daryl Guberman Exposes ANSI- ANAB Wuhan Bio-Level-4, Forensic,& Other Laboratory Certification Scheme, raising eyebrows also in the training Biosafety Level 4 Laboratory User Training Program, China Volume 25, Number 5—May 2019. It states that lab technicians need to possess a high level of training since they are a laboratory’s first line of defense against virus escapes. Pamela Sale, who is the Vice President of Quality for Laboratory Accreditation at ANSI-ANAB, admitted during a deposition in Texas (2017) that there is a significant variation in protocols across different laboratories, suggesting possible inconsistencies in safety precautions. Austin’s crime lab failure points to a national crisis. The confession made by Pamela adds to the conjecture regarding the leakage of the coronavirus from the Wuhan laboratory in 2019, highlighting the significance of stringent procedures and training in upholding safety standards in laboratories. Pamela admits that Protocols were not followed properly in any laboratory, and this more than likely led to the release of the COVID-19 virus.
Guberman’s YouTube channel exposes these groups that are supposed to be checking on companies like Boeing are not doing their jobs properly. He illustrates via his YouTube channel and featured articles they are too open to outside influence and that this is leading to big problems. He believes that changes need to be made to prevent these kinds of problems in the future.
Supplier Relations and Antitrust Concerns
In the video, there is a shift where Daryl Guberman starts talking about how Boeing deals with its suppliers. Suppliers are other companies that provide Boeing with the parts and materials they need to build their airplanes. Guberman points out something interesting about a message Boeing sent to its suppliers back in 2002. This message is called a supplier bulletin. PQIT 02-001-01 July 2002.
In this bulletin, Boeing seemed to favor or prefer accreditations from certain groups, such as ANSI-ANAB. Accreditations are like stamps of approval that say a company meets certain standards. But Guberman knows and shows through feature articles and YouTube channel that by favoring certain accreditations, Boeing has broken the Sherman-Clayton Act of 1914. These rules are called antitrust laws, and they are there to make sure companies compete fairly.
Guberman argues that Boeing, because of its power to regulate itself and influence over these accreditation organizations, are creating a monopolistic environment. A monopoly is when one company controls an entire market, making it hard for other companies to compete. This can be bad for smaller businesses that can’t compete with a big company like Boeing restrictive management and behavior.
Quality Control and Ethical Stewardship
Furthermore, Guberman makes some serious accusations against Boeing. He says that Boeing is using its special privileges to avoid having their inspectors go and check their suppliers on-site per their 2002 Supplier Bulletin PQIT-02-001- 01 July 2002. These checks are called audits/surveys. He also says that Boeing is manipulating or unfairly changing the processes to get certifications. Certifications are like official approvals that say a company is doing things right.
Most manufacturers Guberman stated after 13 years of traveling in the business issuing quality certifications himself via his registrar fully accredited not by ANSI-ANAB state: “The ISO-9001 AS-9100, ISO 13485 (medical) international standards are just PAY TO PLAY for suppliers and subcontractors for Boeing, Lockheed, and others!” This type of thought and action diminishes the value of these certifications and companies that produce parts and registrars that issue ANSI-ANAB certifications. Guberman knows, after 13 years in business and over forty plus years in manufacturing, that Boeing and other ANSI-ANAB board memberships inter-locking directorates have overtime degraded the value of quality and the certifications that ANSI-ANAB registrars dispense to companies.
Guberman exposes via his YouTube and feature articles that these actions by Boeing are putting the quality and safety of their products at risk. Guberman then strongly urges the people who make decisions at Boeing, known as the board of directors, to make big changes. He wants them to let go of the closed-off culture that has been kept going by the current leadership. This culture, he believes, is not open to new ideas and is stuck in its ways.
He proposes that Boeing should consider appointing a new CEO from outside the organization, recommending himself as the external candidate from whom Boeing could benefit, given his over 40 years of experience in quality. With his education rooted in engineering and quality, along with his extensive experience starting as an hourly worker and later ascending to the roles of Quality Manager and Quality Director, he could instigate substantial and impactful changes. This would be a big contrast to the current situation, where the leaders seem to be disconnected from the realities of running the company. Guberman’s strong words serve as a harsh criticism of the way Boeing is run. He shines a light on the complex web of issues involving rules, company influence, and resistance to change. He is calling for responsibility, openness, and ethical behavior within Boeing, which is one of the biggest aerospace companies in the world.
